Welcome to Food Listy. These Terms of Use govern your use of our website at foodlisty.base44.app and our mobile app (together, the "Service"). The Service is owned and operated by Food Listy LLC. By accessing or using the Service, you agree to these Terms. If you do not agree, you may not use the Service. You must be at least 18 years old to use the Service.
How Feedback and Reviews Work
Food Listy uses three kinds of feedback, and they are not the same:
- Private feedback ("The Critical Spoon"). When you submit feedback on a restaurant, your category scores (Food, Service, Vibe, Value) and written notes are private — visible only to you, the business owner, and our admin team. This feedback is never displayed publicly and is never used for advertising.
- Public shoutouts. You can post public, star-free shoutouts about restaurants you love. These are visible to all users but do not include star ratings.
- Starred reviews. Only verified Food Listy Food Critics can publish public star ratings. If you are not a verified critic, your feedback stays private.
How Listings Are Sourced
- Where listings come from. We add businesses to Food Listy from public sources (such as government open-data datasets, public directories, and local news) and through AI-assisted discovery that scans the web for new and under-the-radar food spots.
- Businesses cannot opt out of being listed. Food Listy decides what appears on the Service. A business does not need to sign up or pay to be listed.
- Claiming and corrections. Business owners can claim their listing to manage its details. Owners can also request corrections to inaccurate information.
- When we remove or correct listings. We correct or remove a listing when legally required, when the business has permanently closed, or when listing information is inaccurate and the owner or we cannot confirm correct details.
Badges on Food Listy
We show badges to help you understand what we have verified. All badges are accurate and cannot be purchased:
- Hidden Gem — awarded to listings nominated by foodies and reviewed by admins, verified critics, or Food Listy. It cannot be bought.
- Food Listy Accredited — granted by Food Listy after a critic recommendation and founder approval.
- Verified Critic — shown on profiles of approved Food Critics.
- Claimed — the business owner has verified ownership of the listing.
- Featured — the listing is being promoted through a paid boost or package.
- Newly Opened — the business appears to have recently opened.
- Unverified — we have not yet confirmed the listing's details.
Account Types
Anyone 18 or older can create an account. User accounts let you favorite, save, and share listings, post shoutouts, and submit private feedback. Business owner accounts let you claim existing listings or add new ones, manage listing details, view analytics, and purchase subscription plans, boosts, and credits. You may use a business account for commercial purposes related to your business on Food Listy.
Credits, Boosts & Coupons
- Credits are in-app currency with no cash value. They never expire, and are non-transferable and non-refundable. See our Refund & Cancellation Policy for details.
- Boosts are time-limited promotional placements that begin immediately upon purchase and are non-refundable once activated.
- Coupons are offered by businesses and may have terms set by the business. Food Listy is not responsible for the terms or redemption of individual business coupons.

Food Critic Program
- Application. Any user can apply to become a Food Critic. Applications are reviewed by Food Listy.
- Verification. Approved critics are verified and receive a Verified Critic badge. Only verified critics can publish public star ratings.
- Conduct. Critics must be honest and fair. Critics may not demand payment or favors from businesses in exchange for reviews, and may not retaliate against businesses.
- Removal. Food Listy may remove critic status at any time for misconduct, inaccurate reviews, or violation of these Terms.
Private Feedback & Owner Messaging
- Your identity. When you submit private feedback, you choose whether to show your first name and last initial to the owner, or to stay anonymous.
- Owner follow-up. On eligible packages, the business owner can open a follow-up chat with you about your feedback. If you stayed anonymous, the owner does not see your name.
- No harassment. Owners may not harass, pressure, or retaliate against diners for their feedback, and may not attempt to identify anonymous diners. Argumentative or hostile follow-up chats are paused and flagged for Food Listy review.
- Rewards are for private feedback only. Food Listy may reward diners for submitting private feedback. We do not reward public reviews or shoutouts.
Your Account and Conduct
You are responsible for safeguarding your account and for all activity under it. You agree to provide accurate information and to keep your details current. You may use a business account for business purposes on Food Listy. The following are prohibited:
- Spam, repeated unsolicited messages, or abusive behavior toward other users or businesses.
- Scraping, harvesting, or automated collection of data from the Service.
- Creating fake accounts, impersonating others, or providing false information.
- Using the Service for any unlawful purpose.
- Interfering with the proper functioning of the Service.
- Posting content that is malicious, false, abusive, threatening, defamatory, or infringes someone else's rights.
Content You Post
You are solely responsible for content you post. You retain ownership of your content but grant Food Listy a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, and distribute that content on and through the Service. You must not post content you do not have the rights to.
Intellectual Property
Food Listy and its licensors own all intellectual property rights in the Service, including copyrights, trademarks, and other proprietary rights. We reserve all rights not expressly granted to you.

Reporting, Blocking & Account Deletion
- Reporting. You can report any user-generated content (posts, shoutouts, reviews, comments, or profiles) that you believe violates these Terms using the Report button. Our team reviews all reports and may remove content or suspend accounts.
- Blocking. You can block other users at any time. Blocked users cannot see your content, message you, or follow you.
- Account deletion. You can delete your account at any time from Settings. Deleted accounts enter a 30-day recovery window during which you can restore them by logging in. After 30 days, deletion is permanent and all your data — including posts, reviews, private feedback, comments, likes, saved favorites, credits, and follower connections — is removed.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, SECURITY, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OR CONTENT ON THE SERVICE.
Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOOD LISTY LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, USE, OR DATA, HOWEVER ARISING, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.
Governing Law
These Terms and your use of the Service are governed by the laws of the State of New Jersey, United States, without regard to conflict of law provisions.
Dispute Resolution — Binding Arbitration and Class-Action Waiver
Please read this section carefully — it affects your legal rights.
- You and Food Listy agree to resolve disputes through binding individual arbitration, except as described below. This means that instead of suing in court, you and Food Listy each bring claims individually before a neutral arbitrator.
- You give up your right to go to court and to have a judge or jury decide your dispute. You also give up your right to participate in a class action or class-wide arbitration.
- Class-action waiver. All claims must be brought in an individual capacity. You and Food Listy each agree that no claim may be brought as a plaintiff or class member in any class, consolidated, or representative proceeding.
- Small-claims carve-out. Either party may bring a claim in small-claims court if it qualifies and is within that court's jurisdiction limits.
- How to start. Before filing for arbitration, the party with the dispute must send a written notice to the other party at the contact information below and allow 30 days to resolve the matter. If it is not resolved, the dispute will be arbitrated in New Jersey under the consumer rules of a national arbitration provider agreed upon by both parties.
Changes to These Terms
We may update these Terms from time to time. Changes take effect upon posting. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
